This case is before the Court upon the appeal of Stewart Martin Elliott from the November 13, 1990, final order of the Circuit Court of Lincoln County which denied the appellant's motion for a new trial. The appellant was tried and convicted by a jury on June 6, 1990, of first degree felony murder, sexual assault in the first degree, arson in the fourth degree and two counts of attempted murder.
