Jana Sue Balfany commenced an action against Don and Betty Balfany to impose a constructive trust on life insurance proceeds. The district court for Dawes County sustained the defendants' demurrers to Jana Balfany's second amended petition and dismissed the action when Jana Balfany elected to stand on her pleading.
