Defendant Angelo Pergola appeals from a judgment of the United States District Court for the Eastern District of New York, Reena Raggi, Judge, convicting him, following his plea of guilty, of two counts of mailing threatening communications, in violation of 18 U.S.C. § 876 (1988). He was sentenced principally to two concurrent prison terms of 60 months, an upward departure from the range specified by the federal Sentencing Guidelines...
