Before the court are the motion for summary judgment of the plaintiff United States of America ("United States") and the motion for dismissal or stay of defendant Henry R. Armstrong, M.D. ("Armstrong"). For the following reasons, the United States' motion for summary judgment is granted and Armstrong's motion for dismissal or stay is denied.
