On September 4, 1987, A & B Freight Line, Inc., plaintiff, brought suit in the circuit court of Winnebago County against West Bend Mutual Insurance Co. (defendant) and other defendants not parties to this appeal. Plaintiff alleged that Ray Ryan, the owner of Dean Lyman Agency, acted as an agent for defendant and that during the agency Ryan overbilled plaintiff $451,425.14 for insurance policies issued...
