Danny Stephen Raper was charged with and convicted of driving or being in actual physical control of a vehicle while under the influence of a substance which impaired his ability, in violation of § 32-5A-191(a)(5), Code of Alabama 1975. He was sentenced to 70 days' imprisonment in the county jail, was ordered to pay a fine of $1,400 and court costs, and was additionally ordered to be evaluated by the D.U.I.
