Upon consideration of the record, briefs, and arguments of counsel, the Court is of opinion that the allegations in appellant's motion for judgment do not bring this action within the subject-matter jurisdiction of the trial court. See Haddon v. Metropolitan Life Insurance Co., 239 Va. 397, 389 S.E.2d 712 (1990). Accordingly, the trial court's dismissal of those counts is affirmed.
