Plaintiff, Jacqueline Flynn, brought this medical negligence action against defendant Dr. Thomas Szwed, D.O., an osteopath, for his alleged failure to diagnose hyperparathyroidism. Defendant filed a petition for summary judgment on the ground that allegations in the first amended complaint as to 1978 and 1979 care were barred under the four year statute of repose for medical negligence actions.
