This matter comes before the Court to consider the cross motions of the parties for summary judgment. Fed.R.Civ.P. 56.

The undisputed facts in this case are as follows. Plaintiff Michelle Brill was divorced from her husband on July 8, 1988. Because her attorney had informed her that returning to her maiden name (Walton)
