This is the second appeal in this Workers' Compensation case. In the first appeal we issued an unpublished opinion by which this case was reversed and remanded to the Commission for a determination as to whether the employer was given timely and proper notice of the claimant's alleged occupational disease within the requisite 90-day period and, if not, whether claimant's failure to do so fell within one of the statutory exceptions.
