PAGE v. STATE

No. 90-03608.

585 So.2d 508 (1991)

Spring Celia PAGE, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Second District.

September 20, 1991.

Attorney(s) appearing for the Case

James Marion Moorman, Public Defender, and Jennifer Y. Fogle, Asst. Public Defender, Bartow, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Marc E. Brandes, Asst. Atty. Gen., Miami, for appellee.

PER CURIAM.

Appellant Spring Celia Page was charged with possession of cocaine, a felony, and possession of drug paraphernalia, a misdemeanor. Sitting as trier of the facts, the circuit court convicted her only of the lesser offense. The conviction is not contested on appeal. However, Page correctly asserts that it was error to impose a sentence of community control for the misdemeanor offense. DeLeon v. State, 536 So.2d 305
