Joyce Schlangen defaulted on several mortgage loans which contained "confession of judgment" clauses. The financial institution which loaned her the money threatened foreclosure and Schlangen sought bankruptcy protection under Chapter 11. The matter at issue here arises from Schlangen's adversary complaint which was removed from the bankruptcy court to the district court.
