Defendant Stephen A. Dunker was convicted of aggravated battery (Ill.Rev.Stat. 1989, ch. 38, par. 12-4(b)(3)) following a jury trial in Macon County, Illinois, on November 14, 1990. Defendant was sentenced on December 6, 1990, to a term of probation for 18 months conditioned on a term of imprisonment of 30 days in the Macon County jail.
