The plaintiff, Gregory Parsons, suffered a rupture of a Meckel's Diverticulum on his small intestine while employed by the defendant, Norfolk and Western Railway Company (N & W). After undergoing surgery to repair the rupture, the plaintiff filed suit against his employer pursuant to the Federal Employers' Liability Act (FELA), 45 U.S.C. § 51 et seq., claiming he suffered permanent disability...
