This action was filed on 12 August 1988 by the plaintiff for compensatory and punitive damages for false imprisonment and intentional infliction of emotional distress. Summary judgment for defendants was granted by Judge Henry W. Hight, Jr., on 3 October 1989. The Court of Appeals reversed the trial court on all claims except the punitive damages issue. Judge Phillips dissented in part, reasoning that the plaintiff's forecast of the evidence was sufficient...
