KLEES, Judge.

Carlene Fleming and Robert Cossich were indicted by a grand jury for the first degree murder of George Fleming on November 18, 1986. They were also separately indicted for conspiracy to commit first degree murder. Fleming and Cossich were tried together for first degree murder before a twelve-person jury on January 5-9, 1988. Fleming was found guilty as charged, and the jury recommended a life sentence. Cossich was found guilty of second degree murder...
