Only a belief that bankruptcy is forever could produce a case such as this. When Pettibone Corporation and its affiliates (collectively Pettibone) filed for bankruptcy, some personal injury cases were pending against it. These were stayed automatically. 11 U.S.C. § 362. During the bankruptcy proceedings other personal injury suits were filed despite § 362. Courts put these new tort cases in stasis. Pettibone's plan of reorganization...
