On January 26, 1989, the Workers' Compensation Court determined that the claimant was entitled to an award of reasonable costs and attorney's fees pursuant to § 39-71-611, MCA (1983). An evidentiary hearing was held to determine the amount to be awarded and, on November 30, 1990, the Workers' Compensation Court issued an order awarding attorney's fees of $3,329.39 based on the contingent fee agreement between the claimant and his attorney.
