The defendant, H.L. Anderson, was originally charged with possession of cocaine with the intent to distribute in violation of LSA-R.S. 40:967(A). He pled guilty to possession of cocaine in violation of LSA-R.S. 40:967(C). The trial court sentenced the defendant to a term of imprisonment of three years at hard labor, and recommended him for participation in the intensive incarceration and probation (IMPACT) program.
