OPINION

MEYERS, Justice.

Appellant, L.C. Hardin, appeals from a conviction by the jury for possession of a controlled substance of less than twentyeight grams. Tex.Health & Safety Code Ann. § 481.115(b) (Vernon Pamph.1991). Punishment was assessed by the court at forty-five years in the Institutional Division of the Texas Department of Criminal Justice.
