Talladega Foundry and Machine Company, Inc. ("Talladega Foundry"), sued Rutledge Industrial Corporation ("Rutledge") for $66,910.56 it claimed was due on a stated account, and for work and labor done for Rutledge.1 Rutledge filed a counterclaim alleging breach of express and implied warranties of merchantability and fitness for a particular purpose, as well as breach of contract.
