OPINION

STEFFEN, Justice:

Respondent Raul Acuna allegedly sold cocaine to an individual who was motivated by his own criminal involvement with the law to cooperate with the police. The alleged transaction was monitored electronically and Acuna was arrested and charged with selling a controlled substance. After a preliminary hearing, Acuna filed a pretrial petition for a writ of habeas corpus based upon an asserted violation of this court's holding in
