The issue presented in this appeal is whether the defendant J. William Burns, the commissioner of transportation for the state of Connecticut, can be held liable under the highway defect statute, General Statutes § 13a-144.1 The trial court granted the commissioner's motion for summary judgment and the plaintiff appealed. We affirm the decision of the trial court.
