Ordered that the judgment is affirmed.

The defendant challenges the propriety of the trial court's instructions to the jury regarding his failure to take the witness stand in his own behalf. The defendant's challenge to the charge, however, is unpreserved for appellate review as a matter of law (see, People v Fehr, 75 N.Y.2d 836, supra), and we decline to reach the issue in the exercise of our interest of justice...
