MEMORANDUM

CAHN, District Judge.

The plaintiff has sued the defendants for the violation of various federal and state constitutional, statutory, and common-law duties, the violation of which stems from long-running spousal abuse which culminated in a shooting. Defendants Wilson Police Department ("Department"), Borough of Wilson ("Wilson"), and Richard D. Nace, the Chief of Police of the Borough of Wilson, have moved to dismiss the complaint.
