Respondent is an Albany attorney admitted to practice by this court in 1977. He was suspended by this court for a period of six months effective December 30, 1988 (Matter of Swyer, 143 A.D.2d 462). Respondent's application for reinstatement to practice was deferred pending disposition of the instant charges of professional misconduct.
