The City of St. Paul appeals the trial court's grant of summary judgment for respondent Rice Street VFW, Post No. 3877, in a declaratory judgment action questioning the validity of a St. Paul ordinance. That ordinance required organizations conducting charitable gambling to contribute part of net profits to a fund operated by the city, for distribution to youth organizations in St. Paul.
