NUGENT, Chief Judge.

Defendant Patrick R. Conway appeals from his conviction, under § 576.0401, of official misconduct. He asserts among other things insufficiency of the evidence to support the verdict of guilty on Count II of the two-count indictment. The jury acquitted him on Count I. We reverse the conviction on Count II.
