Plaintiff, Lloyd R. Trackwell, appeals the judgment entered pursuant to verdict which dismissed his negligence action against appellee Burlington Northern Railroad Company. Trackwell's employer, defendant-appellee State of Nebraska, was made a party to protect its workers' compensation subrogation claim.
