OPINION

LAGARDE, Justice.

Mike Spangler, appellant, appeals from an instructed verdict granted in favor of Orville Jones, appellee.1 Spangler raises three points of error, all complaining of the instructed verdict; Jones raises one cross-point. For reasons that follow, we reverse and remand this cause to the trial court for a new trial.
