WORKMAN, Justice:

This case is before the Court upon the appeal of Gary C. Milner from an order of the Circuit Court of Kanawha County granting the Appellee's, Montgomery National Bank's (hereinafter referred to as the bank), motion to set aside the appellant's jury verdict against the bank in the amount of $19,600.001, ruling that there was insufficient evidence to support that portion of the judgment against the bank
