KEYS, Justice.

The plaintiff in execution, Carolyn Jane Couchman, (appellee) filed a motion for damages against appellant, James T. Hickey, Sheriff of Nueces County under Tex. Civ.Prac. & Rem.Code Ann. § 34.065 (Vernon 1989) for failure to execute a judgment. After a bench trial the court rendered judgment in favor of appellee.
