This appeal consolidates two actions initiated by the plaintiff/appellant, Dore & Associates Contracting Inc. (hereafter Dore) in the Circuit Court of Cole County. The Missouri Department of Labor and Industrial Relations (hereafter Department) was common to both actions as a defendant and is the respondent of consequence in this appeal.
