Ordered that the judgments are affirmed, and the matter is remitted to the County Court, Suffolk County, for further proceedings pursuant to CPL 460.50 (5) with respect to the defendants Ernest DeMatteo and Edward DeMatteo; and it is further,

Ordered that the stay of execution of the judgment against Sail Carting and Recycling Co., Inc. is vacated forthwith.
