Plaintiffs Victor and Jacqueline Aglinsky filed a complaint July 6, 1987 in Cuyahoga County Common Pleas Court case number 132233 against defendant Cleveland Builders Supply Company ("CBS"). Plaintiffs allege defendant breached its contract and an implied warranty of fitness for intended purpose by negligently and purposely supplying them with inferior bricks
