In 1977, the plaintiffs, Marcus Batteast, a minor, and his parents, filed suit in the circuit court of Cook County against Dr. Edgar Dela Cruz, his partner, Dr. Joseph Abella, and St. Bernard Hospital, among others, alleging negligence and willful and wanton misconduct in their treatment of Marcus, who, while under the care and supervision of these defendants, was injured from an overdose of a drug manufactured by Wyeth...
