Victoria Menaugh had a verdict against Resler Optometry, Inc. for $25,000.00 actual damages and $125,000.00 punitive damages. The jury found that she was thirty-eight percent negligent and the court reduced the actual damage assessment accordingly, but declined to reduce the punitive portion of the award. The Missouri Court of Appeals, Eastern District, affirmed. We granted transfer to consider questions involving the award of punitive damages...
