On March 19, 1985, the defendant, Pasquale Cardenuto, was convicted of arson and of burning insured property with intent to defraud an insurer. A Superior Court judge allowed Cardenuto's motion for postconviction relief by granting a new trial, and the Commonwealth appeals. Mass. R. Crim. P. 30 (c) (8), 378 Mass. 900 (1979).
