This case is before the court on the defendant's appeal from a Superior Court judgment quieting title to real estate devised under the will of Catherine I. Cole. The defendant, Harold W. Cole, Jr., alleges that the trial justice erred in finding that he was time barred from contesting a will allowed to probate on the basis of a petition for probate that failed to list the heirs of the decedent and which failed to give proper notice...
