The appellant, Larry Dingler, was convicted of theft by shoplifting and two counts of simple battery.

On May 22, 1989, a security guard for a Macy's department store at Gwinnett Place Mall observed Dingler conceal several shirts in a shopping bag and leave the store without paying for the merchandise.
