McMILLAN, Judge.

The appellant was convicted of murder during a robbery and was convicted of capital murder, § 13A-5-40(a)(2), Code of Alabama (1975), and the jury recommended a sentence of life imprisonment without parole, by a vote of five for death and seven for life without parole. Following a separate sentencing hearing, the trial court sentenced the appellant to life imprisonment without parole.
