MEMORANDUM AND ORDER

MORAN, District Judge.

The Metropolitan Sanitary District of Greater Chicago (MSD) brought this action against the United States alleging that it has failed to comply with the terms of an agreement permitting the Glenview Naval Air Station to discharge sewage into MSD's system. The complaint seeks mandamus, an injunction, and civil penalties. In our order of September 29, 1989, we denied the government's motion to dismiss.
