Defendant, Gary Wayne Stephens, appeals the dismissal of his appeal to the district court from a conviction by a magistrate. The district court concluded that the timely filing of appellant's brief is jurisdictional and that a late filing required dismissal. On appeal, defendant contends that a late filing should result in dismissal only if it is unexcused or if it prejudices the appellee.
