Berry, appeal the dismissal by the Superior Court (Goode, J.) of their petition for declaratory judgment and the court's ruling that they are not entitled to prepay their mortgage loan to the defendant, Anthony Tirollo, under the terms of their purchase and sale agreement and promissory note, which were silent on the issue of prepayment.
