MEMORANDUM OPINION

HOGAN, Judge.

Before the Court is defendant's motion to dismiss for lack of subject matter jurisdiction, pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure. In consideration of the motion, and the responses filed thereto, the Court shall dismiss plaintiff's complaint for failure to have filed with the EEOC within the statute of limitations.
