The central issue on appeal in this matter is whether the City Council of New Orleans has the authority to modify the Major Street Plan for the City of New Orleans over the disapproval or non-action of the City Planning Commission. Plaintiffs contend that only the Planning Commission has the authority to modify the Major Street Plan, or alternatively, that if the City Council had authority, it acted arbitrarily and capriciously in passing an ordinance...
