The state appeals an order granting the appellee's motion to dismiss the prosecution against the appellee for trafficking in cocaine. At issue is whether the state's use of a confidential informant acting under a substantial assistance agreement, who initiated and negotiated the cocaine deal with the appellee, deprived the appellee of his constitutional right to due process of law.
