This petition for writ of prohibition arises from petitioner's assertion of the right to counsel at his appearance before a civil session of the San Mateo County Grand Jury. Prior to 1988, the law clearly did not recognize any such right. The question in this case is whether the right was created by 1988 amendments to Penal Code section 939.
