Ordered that the appeal from the order entered November 9, 1988, is dismissed, as that order was superseded by the order entered March 22, 1989, made upon reargument; and it is further,

Ordered that the order entered March 22, 1989, is modified, on the law, by deleting the provision thereof which adhered to the original determination denying that branch of the appellants' motion which was for summary judgment dismissing the claims and cross claims of the Leek parties...
