Appellant Wade was arrested and charged with driving under the influence (OCGA § 40-6-391 (a) (1)) and driving with blood alcohol concentration greater than .12 grams (OCGA § 40-6-391 (a) (4)). A DeKalb County jury acquitted her on the second count but found her guilty on the first.
